Rules and Regulations

General

  1. The Great Trail Treasure Hunt (the “Contest”) is governed by these Rules and Regulations. By entering the Contest, entrants agree to be bound by these Rules and Regulations.
  2. The Contest is administered by Canadian Geographic Enterprise (50 Sussex Drive, Ottawa, ON, K1M 2K1) and Trans Canada Trail (321 de la Commune West, Suite 300, Montréal, QC, H2Y 2E1, (collectively, the “Contest Administrators”).
  3.  The Contest opens at 10:00 a.m., Eastern Time, on June 19, 2019 (“Contest Opening Date”) and ends at 11:59 p.m., Eastern Time, on August 18, 2019 (“Contest Closing Date”). All Contest entries must be submitted and received by Canadian Geographic Enterprise before the Contest Closing Date. Any entries submitted after the Contest Closing Date are not eligible to win any Contest prize.
  4. The Contest is open to residents of Canada who have reached the age of majority in the province or territory in which they reside at the time of the Contest Opening Date. The following persons are not eligible to enter the Contest or to win a prize: employees, officers, directors or representatives of the Contest Administrators, Prize Suppliers, and any volunteers associated with the hiding of any Contest prize box, Strut Creative, and/or the Royal Canadian Geographical Society, and the parents, subsidiaries, siblings and children of, and persons domiciled with, such individuals or entities, or any of the Contest Administrators’ parents, subsidiaries, affiliates, and agencies.
  5. No purchase is necessary to enter the Contest or to win a prize.

Entry

  1. There are two ways to enter the Contest:
    1. Finder Entry: Find a Treasure Box (as described below) and follow the instructions for entering the Contest.
    2. Essay Entry: Legibly hand-print and mail entrant’s name, telephone number and address as well as a hand-printed original 150 – 300-word essay about the importance of The Great Trail in a postage-paid envelope to: The Great Trail Treasure Hunt c/o Canadian Geographic, 50 Sussex Drive, Ottawa, Ontario K1M 2K1. Upon receipt of an entry (including entrant’s name, telephone number, address and essay), entrant’s name will be entered in the Contest and eligible for a chance to win either a Weekly Prize or the Grand Prize (all as described below). Illegible, duplicate or mechanically produced or reproduced essays will not be accepted. Essay entries are not eligible to win a Treasure Box prize.
  2. Contest Administrators and Prize Suppliers are not responsible for any lost, misdirected, damaged, ineligible or waylaid entries.
  3. All Contest entries must be received before the Contest Closing Date.

Finding Treasure Boxes and Redeeming Treasure Box Prizes

  1. 200 official Contest prize boxes (“Treasure Boxes” or “Treasure Box” in the singular) will be hidden along The Great Trail. The Contest Administrators will post information as to the location of the Treasure Boxes between June 19, 2019 and August 18, 2019. The information will be posted online at: www.TheGreatTrailTreasureHunt.ca.
  2. Each Treasure Box will contain, as a finder prize, one “This is Canada” coin.  The first to find the Treasure Box, or “first finder”, may claim the coin and be deemed the winner of the “This is Canada” coin prize.
  3. If, for any reason, the First Finder leaves behind or opts to leave or misplaces the “This is Canada” coin prize, a person who subsequently finds the Treasure Box may be eligible to claim the prize. It is solely the responsibility of the finder of the Treasure Box to take and safeguard the coin prize.
  4. If more than one person finds a Treasure Box at the same time, those finders must determine amongst themselves who the First Finder is. The Contest Administrators and Prize Suppliers assume no responsibility for determining who a First Finder is.
  5. If a Treasure Box is found by another person (Subsequent Finder) after the “This is Canada” coin prize has been claimed, the Subsequent Finder is not eligible to claim the Treasure Box prize.
  6. In addition to the “This is Canada” coin prize, each Treasure Box will also contain a redemption code to be used by the First Finder and Subsequent Finders to validate their finds and receive an entry into the Weekly Prize and Grand Prize draw.
  7. To be eligible to enter the Contest for a chance to win a Weekly Prize or the Grand Prize, a participant must find a Treasure Box and:
    1. Take a photograph of the Treasure Box at the location it was cached;
    2. Validate the find on or before August 18th, 2019, 11:59 p.m., Eastern Time, (“Redemption Date”) by entering the redemption code set out on the Treasure Box into the prize claim form at: www.TheGreatTrailTreasureHunt.ca and complete all other requirements on the prize claim form.
  8. Participants will be encouraged to post their photograph of the Treasure Box to Instagram, Twitter or Facebook using the hashtag #GreatTrailTreasure and tag @cangeo , @thegreattrail / @legrandsentier
  9. Participants who post their photograph of the Treasure Box to Instagram, Twitter or Facebook will receive one additional entry into the Weekly and Grand Prize Draw.
  10. There is no limit on the number of Treasure Boxes that may be found by a single individual.
  11. Participants who find more than one box, and successfully validate their find online, are eligible for one additional entry into the Weekly and Grand Prize Draw, per box found.
  12. Participants who find more than one box are encouraged to post photographs on Instagram, Twitter or Facebook for every box found. Participants who do so will be eligible for one additional entry into the Weekly and Grand Prize Draw, per box found
  13. Participants who successfully find and validate 5 or more boxes, will be eligible for a unique Superuser Prize Draw to happen in conjunction with the Grand Prize Draw

Treasure Box Photographs

  1. All photographs entered in the Contest must be of the Treasure Box at the location it was cached.
  2. All entries are intended for the general public. Entrants are fully responsible for the photographs they submit. Contest Administrators will not accept photographic entries that are offensive and reserve the right to disqualify, in their sole discretion, any photographic entries that contain, for example, racist, hateful, sexist, homophobic or pornographic content.
  3. All photographic entries that are posted to Instagram, Twitter or Facebook must use the hashtag #GreatTrailTreasure.  Participants are also encouraged to tag @cangeo , @thegreattrail / @legrandsentier. Digital files should be at least 1,000 pixels wide for a horizontal image or 1,000 pixels tall for a vertical image at 72 dpi. Content alteration of digital files is not acceptable. Cropping of photographs and tonal or colour corrections are permitted.
  4. All entries become the property of the Contest Administrators and will not be returned.
  5. By entering and participating in the Contest, each winner of a Prize (and his/her/their parent or guardian), and the travel companion of the Grand Prize winner consent to: the use of his/her/their name, address (city and province or territory), comments attributable to him/her/them pertaining to the Contest, a Prize, the Contest Administrators, Prize Suppliers, photographs/videos of the Contest prize winners, and where applicable, the travel companion of the Grand Prize winner. No remuneration in connection with any publicity relating to the Contest, carried out by or on behalf of the Contest Administrators in any manner whatsoever including, without limitation, print, broadcast, the internet and social media, is offered to or required by any entrant or Prize winner.
  6. By entering and participating in the Contest, entrants consent to the use of entrant’s photograph by the Contest Administrators and Prize Suppliers for promotional use, during or after the Contest Closing Date, without compensation. Promotional material includes, without limitation, any print or electronic advertising or marketing material such as posters, online images, newspaper ads, television ads, e-mails and social media content.
  7. Any required waiver forms/model releases are the responsibility of the entrant.
  8. Contest Administrators may share personal information with third parties where otherwise explicitly agreed to by entrants.

Copyright

  1. Treasure Box photographs must not infringe upon or violate any laws or any third party rights, including, but not limited to copyright, patent, trademark, trade secret or other proprietary rights and must not constitute material that would be considered libeling, defamatory, or a privacy violation.
  2. Entrants must obtain all necessary permissions, licenses, clearances, releases, waivers of moral rights and other approvals from third parties (including but not limited to all copyright holders, Prize Suppliers and all individuals appearing in the photograph), necessary to use the photographic entry, in whole or in part, in any way, including to reproduce, make derivatives, edit, modify, translate, distribute, transmit, publish, license and broadcast the photographic entry worldwide, by any means, without limitation.
  3. The owner of a Treasure Box photograph entry retains ownership over the photograph. Each entrant irrevocably and in perpetuity grants the Contest Administrators and Prize Suppliers a world-wide, royalty-free, irrevocable and non-exclusive right and license to use, copy, adapt, transmit, communicate, publicly display and perform, distribute and create compilations and derivative works or merchandise from the photographic entity to promote The Great Trail, the Contest and the Contest Administrators.
  4. Each entrant represents and warrants that he/she/they have the right to grant the license set out above.

Selection of Weekly Prize and Grand Prize Winners

Weekly Prizes: Random draws will be conducted each week of the Contest from all eligible entries received before the draw is conducted. All draws for Weekly Prizes will be conducted by Canadian Geographic personnel at 11:00 a.m. Eastern Time on the Drawing Date set out below at the Canadian Geographic offices (50 Sussex Drive, Ottawa, ON, K1M 2K1). A person is eligible to win only one Weekly Prize per week. The Weekly Prize associated with each draw is as follows:

  1. Grand Prize: There will be one (1) random draw conducted for the Grand Prize from among all eligible entries received before the Contest Closing Date. The draw will be conducted by Canadian Geographic. The draw will be conducted by Canadian Geographic personnel at 11:00 a.m. Eastern Time on August 19, 2019 at the Canadian Geographic offices (50 Sussex Drive, Ottawa, ON, K1M 2K1).
  2. Superuser Prize Draw:  There will be (4) random draws conducted for the Superuser Prizes from all eligible entries received before the Contest Closing Date.  The draw will be conducted by Canadian Geographic. The draw will be conducted by Canadian Geographic personnel at 11:00 a.m. Eastern Time on August 19, 2019 at the Canadian Geographic offices (50 Sussex Drive, Ottawa, ON, K1M 2K1).
  3. Unredeemed Treasure Boxes: There will be one (1) random draw for the Treasure Box Prize conducted for each Unredeemed Treasure Box from among all eligible entries received before the Contest Closing Date. The draw will be conducted by Canadian Geographic personnel at 11:00 a.m. Eastern Time on August 19, 2019 at the Canadian Geographic offices (50 Sussex Drive, Ottawa, ON, K1M 2K1).
  4. Selected entrants for the Weekly Prizes, Unredeemed Treasure Boxes, Superuser Prizes or the Grand Prize will be notified by registered mail, or by telephone no later than five (5) business days after the draw, followed by a written notification. The winner has three (3) business days after notification to confirm receipt of the notification and acceptance of the prize subject to these Rules and Regulations. Failure to confirm receipt of the prize notification or acceptance of the prize by the stated deadline means the winner forfeits the prize and the prize will then be awarded to an alternate winner selected by random draw from all remaining eligible entries following the same process.
  5. With the exception of the Grand Prize, all prizes will be delivered to the winners by mail or by an alternative process agreed upon by the Contest Administrators, Prize Suppliers and the winner. All decisions of the Contest judges are final.
  6. Winners will receive no compensation, credit or prizing other than as disclosed in these Rules or otherwise provided at the sole discretion of the Contest Administrators. Prizes are not transferable; no prize substitutions or equivalents are permitted, except by the Contest Administrators or Prize Suppliers at their discretion. In all cases, the Contest Administrators and Prize Suppliers reserve the right to substitute a prize of equal or greater value for any of the Prizes.
  7. Prize value is an estimate; actual retail value will vary depending on where the prize is shipped and on the rate of exchange at the time the prize is awarded. All prizes must be accepted as awarded and may not be used in conjunction with any other offer or promotion, sold, exchanged, redeemed for cash, combined with any other promotion, or exchanged for a different prize. Allow six to eight weeks for delivery of prizes.
  8. To be declared a winner, the selected entrant/claimant must:
    1. correctly answer, unaided, a time-limited skill testing question; and
    2. sign and return a declaration and release form:
      1. confirming eligibility and compliance with these Rules and Regulations;
      2. consenting to the use, without further compensation, of his/her/their name, address (city and province or territory of residence) and photograph(s) in any Contest-related publicity and
      3. releasing the Contest Administrators, and Prize Suppliers their directors, officers, employees and their respective agents, affiliates, parents, subsidiaries, and assigns, from all liability arising in connection with the Contest or the acceptance, use or redemption of a Prize as awarded. The declaration and release must be returned to the Contest Administrators within ten (10) days after receipt. Entrants/claimants who fail or are unable to meet any of these Rules and Regulations may be disqualified and alternate potential winner(s) will be selected.

Grand Prize Conditions

  1. Canada’s East Coast Fins & Fiddles.(A designated Canadian Signature Experience by Destination Canada). July 28 – Aug 7, 2020, Includes a Twin private cabin for two – valued at USD $12,990. Sailing in comfort aboard the well-appointed RCGS Resolute, this Canadian Signature Experience expedition cruise takes travellers to islands and remote areas of Canada’s East coast. Eastern Canada is famous for its rich and diverse culture, found in small fishing communities and remote ports. The area is well known for its Celtic traditions and the music and cuisine of the region is celebrated the world over. The region also offers a staggering abundance of wildlife, birdlife, and marine mammals and even an encounter with the fabled wild horses of Sable Island. This opportunity to explore the wonders of Canada’s East Coast includes all meals and accommodation for two on board in a Twin Private Cabin, Zodiac excursions, ship transfers, and expedition gear. (valued at US$12,990). Note – any international or local airfare is not included.
  2. The Grand Prize includes only the elements of the cruise identified by One Ocean. Costs related to the Grand Prize but not included in the Grand Prize (such as, for example, travel to/from the cruise departure point, food and beverages not included with the cruise, any travel or medical insurance, medical costs, excursion costs not included in the cruise, applicable taxes, gratuities, spending money, etc.) are the sole responsibility of the winner and/or the winner’s travel companion. Winner and winner’s travel companion are responsible for ensuring they comply with all applicable One Ocean Expedition travel/cruise requirements.
  3. In the event the winner and/or the winner’s travel companion is/are not eligible/able to travel on the cruise dates specified, winner may contact One Ocean to attempt to arrange alternative travel dates. Consent/authorization to change cruise dates is solely at the discretion of One Ocean Expedition and consent/authorization may be refused. Any costs associated with any change to travel dates/itinerary are solely the responsibility of the winner/winner’s travel companion as applicable. Dates of departure and return may be subject to change by One Ocean. In the event the Grand Prize is not available for any reason outside the control of the Contest Administrators, no substitution or compensation will be provided.
  4. If requested by One Ocean, the winner and travel companion must provide a physician note, acceptable to One Ocean, confirming the winner’s and travel companion’s ability to travel and/or participate in cruise events as required by One Ocean. Any fees or costs associated with obtaining the physician note are the sole responsibility of the winner and travel companion.
  5. The winner and travel companion must have valid travel documents (i.e., valid photo identification, etc.) prior to departure or the prize will be forfeited. The winner and companion are solely responsible for obtaining and/or renewing travel documents in order to travel. The Contest Administrators assume no liability for ensuring the winner and/or travel companion are eligible/able to travel.
  6. By accepting the prize, the winner agrees to hold the Contest Administrators and their respective agencies, affiliates, parent(s), subsidiaries, agents, advertising and promotion agencies and anyone else involved in the development, production or handling of the Contest and their respective directors, officers, employees and assigns, harmless against any and all claims and liability arising out of acceptance or use of the Grand Prize, including, but not limited to, travel-related injuries and/or death. The winner and travel companion assume all liability for any injury or damage caused, or claimed to be caused, whatsoever and howsoever arising, by participation in this Contest or use or redemption of any prize including the Grand Prize.
  7. The winner’s travel companion must also sign and return a release form prior to travel. If the winner’s travel companion is not of age of majority at the time the prize is awarded, the winner must provide confirmation, satisfactory to the Contest Administrators and One Ocean Expeditions, that the companion has the consent of the companion’s parents or legal guardian to accompany the winner as well as a release form signed by the companion’s parents or legal guardian. If the companion, or parents or legal guardian, does not sign and return the release form prior to travel, the companion will not be permitted to travel and no compensation or prize substitution will be awarded.

Chances of Winning

  1. The chances of winning a Treasure Box Prize will depend on skill of the person searching for the Treasure Box and the location of the person relative to the location of the Treasure Box.
  2. The chances of winning a Weekly Prize or the Grand Prize will depend on the number of eligible entries received.
  3. The chances of winning a Treasure Box Prize from an Unredeemed Treasure Box will depend on the number of Unredeemed Treasure Boxes and on the number of eligible entries received.

Additional Rules

  1. The Contest Administrators and Prize Suppliers are excluded from all liability for any personal injury, loss or damage of whatever kind (including data) cause directly or indirectly, in whole or in part, from uploading photographic entries and material to the Contest website. The Contest Administrators and Prize Suppliers are not responsible for any failure of the Contest website during the Contest, problems or technical malfunctions of computer online systems, servers, access providers, computer equipment, software or any e-mail, online or internet entry lost due to technical problems or traffic congestion on the internet or at any website or any combination thereof, including any injury or damage to an entrant’s or any other person’s computer or property related to or resulting from uploading any photographic entry to the Contest.
  2. The Contest Administrators reserve the right, with the consent of the Régie des alcools, des courses et des jeux, to terminate or suspend the Contest or to amend these Rules and Regulations at any time and in any way, without prior notice, for any reason whatsoever. Without limiting the foregoing, if for any reason the Contest is not capable of running or being completed, as originally planned (for example, as a result of tampering or infection by a computer virus) the Contest Administrators reserve the right, with the consent of the Régie des alcools, des courses et des jeux, to cancel the Contest.
  3. The Contest Administrators, in their sole discretion, may disqualify any individual who attempts to undermine the legitimate operation of the Contest by tampering with any website mechanism, or who violates these Rules and Regulations.
  4. By entering and participating in this Contest, each entrant agrees to hold harmless the Contest Administrators, Prize Suppliers, The Royal Canadian Geographical Society, and, their directors, officers, employees, agents, affiliates, parents, subsidiaries, and assigns from any liability for damage, injury, death, loss, cancellation or other liability arising from the entrants acceptance or use of a Contest prize or substituted prize or having participated in this Contest including, without limitation, claims based on publicity rights, defamation, invasion of privacy, travel-related injuries and/or death, or from the use, misuse or malfunction of a prize or substitute prize. Winners assume all liability for any injury or damage caused, or claimed to be caused, whatsoever and howsoever arising, by participation in this Contest or use or redemption of any prize.
  5. The Contest Administrators, Prize Suppliers, Royal Canadian Geographical Society, and their directors, officers, employees, agents, parents, subsidiaries, and assigns assume no liability for losses incurred as a result of a cancellation of the Contest or for any reason whatsoever or through the acts or defaults of any company or person providing a prize or for events occurring after the award of a prize. All such losses or expenses will be borne by each individual prize winner. Decisions of the Contest Administrators regarding all aspects of the Contest are final.
  6. Prize Winners must comply with all applicable retailer requirements. Any questions, concerns or requests for service or warranty claims for the SPOT X 2-Way Satellite Messengers, Nikon cameras or Grand Prize must be directed to the manufacturer or One Ocean Expeditions as applicable. The Contest Administrators and Prize Suppliers accept no responsibility for any lost, stolen, damaged or defective products or for any negative trip experiences.
  7. By participating in the Contest, each entrant agrees to be bound by these Rules and Regulations. In the event of any dispute as to whether a person is an entrant, a potential winner or a winner, or as to the qualification of any entrant, potential winner or winner to, or the adequacy of any prize or any substitute prize, the decision of the Contest Administrators will be final.
  8. For Residents of Quebec Only: any litigation respecting the conduct or organization of a publicity Contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any such litigation respecting the awarding of a prize to any resident of the Province of Québec may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
  9. The Contest Administrators respect every entrant’s right to privacy. By entering this Contest, each entrant is deemed to automatically have provided his/her/their consent that personal information collected from entrants may be used by the Contest Administrators, Prize Suppliers or their affiliates to administer the Contest or as otherwise provided in these Rules. Neither the Contest Administrators, Prize Suppliers nor their affiliates will share personal information relating to entrants with any third parties, except as necessary for the administration of the Contest, as provided in these Rules, as otherwise explicitly agreed to by entrants or as may be required by law. Any conflict or discrepancy between this rule and any applicable laws or regulations of Canada, or the provinces or territories of Canada, with respect to privacy, shall be resolved in favour of such applicable laws or regulations. The Contest Administrators, and Prize Suppliers will not attempt to contact the entrant for any purpose other than as may be required by law unless they have opted-in to receive relevant communications from the Contest Administrators.

  11. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Rules and Regulations, or the respective rights and obligations of the prize claimants and the Contest Administrators in connection with the Contest, shall be governed by, and construed in accordance with (i) the laws of the Province of Québec and the laws of Canada applicable therein with respect to the residents of the Province of Québec, and (ii) the laws of the Province of Ontario and the laws of Canada applicable therein with respect to residents of the other Canadian provinces and territories, without regard to conflicts of law principles. Any attempt by a participant or any other individual to deliberately damage any website or undermine the legitimate operation of the Contest could be a violation of criminal and civil laws and, should such an attempt be made, the Contest Administrators reserve the right to seek damages from any such person to the fullest extent permitted by law. The Contest is subject to all applicable federal, provincial and municipal laws. Void where prohibited.
